1. About these terms
These terms apply to the website worldwideaircraftmarket.com — World Wide Aircraft Market — run by Llorenç Palliser Gomila as an independent, non-profit project ("we"). By using the website you accept them. For anything about them, write to palliser@worldwideaircraftmarket.com.
2. What the service is
World Wide Aircraft Market is a showroom of aircraft for sale: it publishes adverts that sellers provide, with their photographs, specifications and location, so that buyers can find them and contact the seller.
- It is free: nothing is charged for browsing, for publishing an advert or for a sale.
- It is not a broker, dealer or agent. We are not a party to any contract between buyer and seller, we do not negotiate on anyone's behalf, and we do not handle payments.
- We review adverts before publishing them, but we do not inspect aircraft and cannot guarantee what a seller states.
3. Using the website
You may browse, search and share the website freely. You agree not to:
- use it for anything unlawful, fraudulent or misleading;
- collect the contact details of sellers to send them unsolicited messages;
- interfere with the website's security or operation, or overload it with automated requests;
- copy the website, its software or its 3D showroom, beyond what the law allows.
Search engines and other automated readers are welcome to read and index the website within the rules of its robots.txt.
4. Publishing an advert
Anyone who owns an aircraft, or is authorised to sell it, may ask us to publish it. By sending us an advert, you confirm that:
- the aircraft exists and is really for sale, and you are its owner or are authorised to sell it;
- what you say about it is true, complete in what matters and up to date — and you will tell us if it changes, or when the aircraft is sold;
- you have the right to use the photographs and every other content you send, and they do not infringe anyone's rights;
- the contact details you give are yours, or you are authorised to use them.
You keep all rights to your content. You grant us, free of charge and for as long as the advert is online, a non-exclusive licence to publish it on the website — adapted to its layout, shown in all its languages, on its maps and in its search, and in the previews of links shared from it.
We may decline to publish an advert, edit it to fit the website's format (never to change what it says), or remove it — in particular if it breaks these terms, if the aircraft is no longer for sale, or if we cannot confirm what it states. If we remove an advert, we tell the seller why.
5. Buying
Everything about a purchase — the price, the inspection, the documents, the payment and the delivery — is agreed between buyer and seller. Before committing to anything, check the aircraft, its records and its owner independently: an independent pre-purchase inspection, the logbooks, the airworthiness directives and the registration with the aviation authority of the country of registry. Never pay anything before you are sure who you are paying. The questions page has more advice.
6. What may not be published
Adverts may not contain or relate to:
- aircraft that are not for sale, do not exist or do not belong to the seller;
- stolen aircraft, or aircraft whose sale is prohibited;
- false or misleading information, or a price meant to lure rather than to sell;
- content that infringes someone else's rights — photographs taken from other adverts, for example;
- personal data of other people without their consent;
- anything else that is illegal.
7. Reporting a listing
If you believe a listing is illegal or breaks these terms, tell us at palliser@worldwideaircraftmarket.com, with:
- the address (URL) or the registration of the listing;
- why you believe it is illegal or breaks these terms;
- your name and e-mail address (unless the report concerns certain serious offences, where you may stay anonymous);
- a statement that you make the report in good faith and believe it to be accurate.
We review every report diligently and objectively, and tell you what we decided and why. If we remove or restrict an advert, the seller is told the reasons and can reply to us to contest the decision. We may stop publishing adverts from anyone who repeatedly publishes illegal content, and stop handling reports from anyone who repeatedly sends unfounded ones.
8. Intellectual property
The website, its 3D showroom, its software, its design and texts and the World Wide Aircraft Market logotype belong to Llorenç Palliser Gomila, unless stated otherwise; see the legal notice. Content published in adverts belongs to its sellers.
9. Liability
We work to keep the website available, secure and correct, but it is offered as it is and without charge, and we cannot promise that it will always be available or free of errors. As far as the law allows, we are not liable:
- for what sellers say in their adverts, or for the condition, airworthiness, ownership or legal status of any aircraft;
- for anything agreed or done between buyers and sellers, including any payment;
- for losses caused by interruptions, errors or the unavailability of the website.
Nothing in these terms limits a liability that the law does not allow to be limited, nor your rights as a consumer.
10. Changes
We may change the website and these terms. The version in force is always the one published here, with its date; if a change is significant, we will say so on the website.
11. Law and jurisdiction
These terms are governed by Spanish law. If you are a consumer, you keep the protection of the mandatory rules of your country of residence, and you may bring any claim before its courts.
